Statement Of Use Filing Tips

Notice of Allowance:

The United States Patent and Trademark Office (USPTO) will provide you with a Notice of Allowance six months before the deadline for filing either a Statement of Use or a six-month extension.

Statement of Use Requirements:

To file a Statement of Use, it is necessary that you are actively engaged in selling your branded products or providing your services in the United States.

Submission Limitations

Once you submit a Statement of Use, you are not allowed to include proof of use that occurred after the initial proof of use filing. If the filed statement is deemed insufficient, you will be required to restart the application process from the beginning.

Six-Month Extension

You are eligible to apply for a six-month extension to meet the Statement of Use requirement. You can request this extension up to a maximum of five times.

Missing Deadlines

In case you miss any deadline, there is a six-month grace period during which you can revive the application by paying a fee. However, after this grace period, the application will be considered dead and cannot be revived.
